What is surrogacy law?

The surrogate mother will be recognised as the legal mother of a child born through surrogacy (even if she is not genetically related to the child). As well as this, if the surrogate is married, her partner will be treated as the child’s legal father. Legal parenthood can be transferred by parental order or adoption after the child is born.

What is a Parental Order? 

A parental order is a court order which makes the intended parent(s) the legal parents of the child. This permanently removes the parenthood of the surrogate and their spouse.
